Back when everyone was trying to make the fact that NAR petitioned the Supreme Court for a writ of certiorari to the DC Circuit Court’s decision in favor of the Department of Justice, I said that filing the petition was not news. If the Supreme Court grants certiorari, that would be news.

I didn’t think NAR had a chance to get the high court to review the proceedings below, since they were pretty darn obvious to me.

Well, today, the industry press is reporting on the Department of Justice’s brief to the Supreme Court urging them to deny certiorari to NAR. I thought it might be interesting to take a look to see if the DOJ wrote anything of particular interest that might hint at where they will take things next year.

There wasn’t much, but let’s take a quick look to see what was said.
