As I am sure any reader of Notorious ROB knows by now, MLS PIN has filed a response to the Department of Justice’s Statement of Interest. It is really well done. Clearly written, well-argued — hard to fault it as a piece of legal motion practice.

Given the quality of arguments, I think there’s a decent chance that Judge Saris would overrule the DOJ and grant final approval to the MLS PIN settlement. But it isn’t a slam dunk.

And there is one major eyebrow raiser in this, which makes me wonder if the move is strategic in nature. If so, that’s a pretty big gamble MLS PIN is taking. There is also a smaller rhetorical point we need to address.

Let’s analyze it together.
