I finally got around to reading the NWMLS Motion to Dismiss in its lawsuit against Compass, which was filed on July 1. And this is how a legal brief is supposed to be drafted. It is supposed to build a block, then build another, and then keep building towards an obvious conclusion. I assume that the three attorneys from Stoel Rives wrote this, and kudos to them for a really well done job.
Now, as is normal, their legal arguments are going to seem bulletproof because we just read (well, I just read) the brief whose entire purpose is to make arguments seem bulletproof. I am certain to completely change my mind once I see Compass’s response to this motion, which will also be (probably) drafted to be bulletproof.
Nonetheless, it is entertaining and educational to consider the arguments that NWMLS makes here. There’s a lot there and until we see Compass’s response, boy they sure do seem convincing.
