Let’s consider this a followup post to this one:
I just read through Consumer Federation of America’s press release on buyer agency agreements, as well as the full report on CAR’s new buyer agency agreement authored by a law professor.
I’ll keep it short: if you are a brokerage in California, I would urge you not to use CAR’s form. Instead, copy eXp’s new buyer agency agreement. (eXp has expressly granted permission to the industry to do so.) If you are not in California, I would still urge you not to use your Association or MLS form, but to copy eXp’s form instead.
