There hasn’t been a ton on the legal side of the industry that interested me enough to read court filings and analyze them. Well, until there was the court’s final approval in Gibson v. NAR, but… I don’t know… the importance of that one was how the court might deal with the big NAR settlement in Burnett v. NAR, and I figured we’ll know soon enough about that decision.

But Inman just reported on Homie’s latest filing in Homie v. NAR, the case I wrote about here a couple of months ago. I went looking for the filings, and found at least one Motion to Dismiss, as well as Homie’s response to that motion. I thought it worth teasing out what the substantive defenses by the defendants are, and what Homie’s legal theory is for moving forward.

I think these are interesting, since I believe that Homie v. NAR is possibly the next major shoe to drop. And there are a few really interesting things going on in this lawsuit.
